Compensation Claims Case Study: Back Injury at Work

The Claimant worked as a heavy goods vehicle driver with one of his responsibilities being to remove goods transported in metal cages. The cages contained an assortment of parcels and boxes and he was moving one of the cages using a pump truck when he felt a sudden pain in his back, suffering an injury. The case argued that there was no system in place to determine how heavy the cage was and because of this unknown weight, the injury was sustained.


The injury to the back resulted in the Claimant being off work for a month and he also undertook a physiotherapy treatment course.  Although the injury improved, it was thought he would have some minor but permanent back problems that would affect his ability to carry out heavy work.

At the beginning of the accident claim, liability was denied because it was said the Claimant didn’t check the weight of the cages before moving them and that they believed they weren’t too heavy. Since liability was not accepted the case entered Court proceedings where full liability was admitted and a settlement proposal was put forward and agreed to, to the sum of £13,000.
