Compensation Claims Case Study: Pedestrian Hit by Van

Here is a look at a successful no win no fee accident claim. Details have been changed for privacy reasons but this is indeed a true Ward & Rider accident claim case.

One of our legal executives, Phil Mulryne, was acting on behalf of a Mrs R from Coventry on a no win no fee basis for a traffic accident claim. Mrs R was waiting for a bus on the footpath after a shopping trip when a van which was on the footpath reversed into her. The Claimant was then knocked to the ground and sustained significant injuries, which included a fracture to the right wrist, soft tissue injury to the lower back, temporary hearing loss and a fracture to the right jaw which broke the bottom set of her dentures.The van driver was charged with criminal proceedings and the van driver’s insurance company admitted subsequent liability.

Although the injuries improved, there was a risk of requiring further treatment and surgery to the wrist but because of her age Mrs R wished to avoid this and it was also thought that the Claimant would need further treatment to treat the back injury although this was partly due to the worsening of a condition that was already existent. The injuries meant being out of action as a result of the accident and having to rely on her family to carry out household duties such as ironing, housework and shopping duties which her husband had to do. This would most likely continue in the future as the Claimant would require assistance to complete these tasks.

Ward and Rider successfully secured a settlement for the compensation claims to the sum of £48,000, which was to cover the personal injuries suffered, expenses for damaged items and to cover care and assistance that was provided by her family members.
